For the first time I have had one of my images published, so I should be cock-a-hoop you would think? Sadly not, as the magazine that has used my picture did not seek my consent, more rather they simply grabbed it off FT.

Watch this space...

Sadly this happens to me all the time....!
I've found stolen images of mine frequently over the years, and it's happened twice in the last three weeks....and they are just the ones I've found!!!!!

It's a sad state of affairs, but it no longer surprises me!

Your story regarding xxxxxx (http://www.stealingsite.com/articlewiththeft) has used a copyright photo, of which I am the copyright holder. As a media publisher, I'm sure you understand the necessity of ensuring that an authour's copyright is not violated.

I have not recieved any requests for use of the photo from your organization. As you have chosen to use it prior to gaining my permission, I can only find that you have no regard for my copyright.

This is unacceptable. Please reply immediately - acknowledging the cessation of the use of the photo and your plans for compensation of the use thereof during the past 3 weeks, in contravention of my copyright.

I am sure you, as I, would like to settle the matter quickly without further escalation. Please respond as soon as possible.

It would take years and would cost a fortune with no guarantee of success, in the end it's just not worth the time and effort, and certainly not worth the stress involved !

Very true Meg. Last year I noticed a sunrise picture plastered all over my town on flyers for a fund raiser for some gal with cancer. I think the picture was pinched off my Flickr account. I wish the person would have just asked but really some people just don't understand the concept of copyright on the internet really.

I had the City of Paradise sign up for a Fotothing account last week so they could ask for permission to use one of my photos. That's the way it should be done but usually it isn't.

I guess you just have to decide what battles are worth it.

UPLOAD SMALL low rez pictures if you are worried about it or don't post at all!!!!!!!!!

I'm taking several lines of advice. I suspect that going full tilt and trying to extricate huge sums of money is not the correct way.

I have already been offered the chance to do a cover for the publication concerned and they also offered to do a story about my hobby (Not my cup of tea all that self promotion).

I think it would be right for them to pay me their usual fee for using an image and hope that they will come to me for more local shots as and when they need them. That way I might be able to make a bit of spare cash and get more exposure.

Just to note... I haven't had to follow up beyond that first letter usually. Most people are very apologetic. The insuation of legal action tends to get them to pay attention. I've never gone beyond that. :)
